This is in answer to your letter of October 25 in which you raise the following question:

"Can any appointed person in city government other than the Mayor and the Clerk-Treasurer be authorized to sign checks?"

Our response to your question would be in the negative. KRS 92.060(3) provides in part as follows:

"(3) The treasurer shall receive and safely keep all money belonging to the city. He shall pay it out as directed by order of the city council, but only upon warrants drawn by the mayor and countersigned by the clerk of the city council. . . ." (Emphasis added).

The above statute clearly requires that money belonging to the city shall be paid out only upon warrants drawn by the mayor and countersigned by the clerk of the city council. This is a mandatory provision as pointed out in the case of City of Princeton v. Baker, 237 Ky. 325, 35 S.W.2d 524 (1951). See also City of Shelbyville v. McGrath, 199 Ky. 238, 250 S.W. 976 (1923).
