The Green River Valley Water District began in Hart County, but was enlarged to cover territory located in Barren and LaRue counties pursuant to KRS 74.110 and 74.115.
You are of the opinion that LaRue County should be represented on the Green River Valley Water District Board. We think you are correct.
We assume: (1) That the water district was first organized in Hart County and extended to the other two counties; (2) That the water district does not operate as a single county district as described in KRS 74.020(1)(c); (3) That KRS 74.020(1)(b) applies to this situation. Under the latter provision, the board of water commissioners must be appointed as follows: the respective county judges, with approval of the fiscal courts concerned, shall appoint, in addition to the existing membership of the commission, two (2) members from the original one-county district and two (2) members from the newly extended portion of the district. Here this means that a new member should be appointed from Barren County and a new member from LaRue County.
