Opinion

Opinion By: Robert F. Stephens, Attorney General; By: Carl Miller, Assistant Attorney General

You have requested an opinion of the Attorney General as to whether the Woodford County Rescue Squad may legally incorporate. You state that the rescue squad is a part of the Versailles-Woodford County civil defense.

There is no reason why a rescue squad may not incorporate under the statutes providing for nonprofit corporations. KRS 273.161-273.390. The statute expressly provides that such a corporation may be for a purpose which is civic, patriotic, political or governmental. KRS 273.167. The fact that the rescue squad is funded primarily with city and county money is no reason why it may not incorporate.
