This is in answer to your letter of April 12 in which you relate that the Rowan County Fiscal Court has refused to pay a claim submitted by the Rowan County Board of Election Commissioners for their monthly meetings of March 7 and April 4, 1978. Under the circumstances you raise the following question:

"Who is responsible for paying the County Board of Election Commissioners?"

The answer to your question is found under KRS 117.035 (2) from which we quote the following:

". . . Compensation of members [county boards of elections] shall be set by the fiscal court at not less than fifteen dollars ($15) per day for each day the board meets."

Under the clear language quoted above, the fiscal court is required to pay election board members the compensation fixed pursuant to the statute for each day the board meets, providing of course the board submits sufficient information to show that such meetings actually took place.
