This is in answer to your letter of March 24, 1978 in which you relate that the duly elected Jailer of Garrard County passed away on February 18, 1978 and you appointed someone to take his place. You desire to know the date that an election would be required to fill this vacancy for the unexpired term.

The vacancy in question must be filled at the November 1979 election as there will be no qualifying election pursuant to Chapter 152 of the Constitution in 1978.

Section 152 of the Constitution requires all vacancies in elective offices to be filled at the regular election embracing the area in which the vacancy occurs.
