This is in answer to your letter of November 29 in which you desire to know whether or not an attorney must reside within a city of the fourth class in order to serve as city attorney.
Pursuant to a 1976 amendment to KRS 69.560, governing the appointment of city attorneys in cities of the fourth class, you will find the following provision:
". . . The city attorney must be a practicing attorney, and a resident of the city or of the county wherein the city is located. . . ."
Under the terms of the above statute, the city attorney of a city of the fourth class may reside either in the city or in the county wherein the city is located.
