You have requested an opinion of the Attorney General as to whether a board of zoning adjustment may meet in closed session because of threatening phone calls.
It is our opinion that such a reason is not included within the exceptions provided for the Open Meetings requirement in KRS 61.810. The purpose of the Open Meetings Law is to guarantee that the public's business shall not be transacted in private. The statute provides certain exceptions but threats or intimidation are not included in the exceptions.
You also ask if the minutes of the board of zoning adjustment are open to the public.
A public agency speaks through its minutes and such minutes are public records and open to public inspection under the Kentucky Open Records Law, KRS 61.870 - 61.884.
