This is in response to your letter of February 28 concerning the compensation allowed members of the city council of a fourth class city pursuant to KRS 86.053.
KRS 86.053 was amended in 1974 to read as follows:
"The compensation paid to members of the legislative bodies of cities of the fourth class which operate under the councilmanic form of government shall be fixed by the legislative bodies of such cities in a sum not to exceed $3,000 per annum."
You will note from the above amendment that the compensation of $25 per actual legislative day was changed to place councilmen on an annual salary basis, not to exceed $3,000 per annum.
Since this is the year to elect members of the city council for regular terms, the compensation may be fixed pursuant to the above statute not later than the first Monday in May of this year pursuant to KRS 64.580.
We might also point out that members of the city council would not be entitled to receive lump sum expense accounts in view of KRS 64.710.
