In Utah, lawmakers are considering a measure that would ban release of mug shots until a person has been convicted of a crime. The proposal aims to make mug shots a private record to limit their impact on people's lives.

Opponents maintain, "The very tenets that the public rely on to be able to understand what's going on in government are the very tenets that are the most threatened when legislatures start considering closing down the public records."

In a line of authority dating from the 80's, the KYOAG has recognized, "[i]t is contrary to the principles of personal liberty recognized in this nation for persons to be secretly held in jail." Rejecting privacy arguments, the AG has required disclosure of mugshots/booking photos.

In 2016, KY lawmakers limited access to mugshots obtained thru KORA. "A person shall not utilize a booking photograph if it will be placed in a publication or posted on a Web site & removal from the publication or Web site requires the payment of a fee or other consideration."
