The stakes are very high in this case. At issue is the "competitive harm" test first adopted by the US Supreme Court in the 1974 case National Parks & Conservation Association v Morton.

The test requires a showing of "substantial harm to the competitive position of the person from whom the information was obtained." There is great concern that the Court may "drastically narrow information [about government spending] that is currently available under FOIA."

Open government advocates will be watching this case closely to see in what direction the Supreme Court takes the federal law.
