A reminder that even where the law is abundantly clear (see, KRS 61.840 declaring that "all agencies shall permit news media coverage, including but not limited to, recording and broadcasting"), agencies regularly get it wrong. Here, a high ranking public official acknowledges the presence of a quorum and the discussion of public business, but suggests there is room for legal disagreement about whether the meeting was subject to the open meetings law. He's wrong.

His comment that "we'll let other people worry about that [open meetings compliance]" suggests the depth of his commitment to open government, or obvious lack thereof.

BTW, the right to record public meetings has been extended to the public in open meetings decisions issued by the attorney general that have never been successfully challenged. This means that a person attending a public meeting may record the meeting even if he or she is not a media representative.
