The Office of the Kentucky Attorney General released the following Opinions and Open Records/Open Meetings Decisions last week. The summaries are provided here. To read the decisions, go to: https://ag.ky.gov/orom/Pages/2019-OROM.aspx

1. 19-ORD-214 (Jefferson County)

City of Jeffersontown violated the Open Records Act by responding to request in an untimely and insufficient manner and by denying right to inspect records on city premises; and subverted intent of the Act by excessive delay in access to public records.

2. 19-OMD-215 (Madison County)

The January 7, 2019 special meeting of the Berea City Council ("Council") Audit and Finance Committee ("Committee") was not a Council meeting held in violation of the Open Meetings Act ("Act"). There is insufficient evidence that the Council violated KRS 61.810(1) when members attended the special Committee meeting. The Council violated KRS 61.823(3) by failing to provide written notice of a special meeting that included an agenda, and violated KRS 61.823(4)(c) by failing to post a written notice of a special meeting that included an agenda. This office does not have the authority to review arguments relating to remedies to alleged violations of the Act.
