1. 20-ORD-055 (Fayette County)

Fayette County Public Schools ("FCPS") subverted the intent of the Open Records Act ("Act"), short of denial, when it declined to accept an open records request via e-mail. FCPS also violated the Act when it withheld responsive records as preliminary under KRS 61.878(1)(i) and (j) after those records had been adopted through final agency action.

2. 20-ORD-056 (Jefferson County)

Louisville Metro Government's ("Metro") did not violate the Open Records Act ("the Act") in denying a request based on the nonexistence of responsive records. Metro discharged its duty under the Act by conducting a good faith search for responsive records.

3. 20-ORD-057 (Elliott County)

The Little Sandy Correctional Complex ("Complex") carried its burden of proof that it never received a request for records under the Open Records Act ("the Act"). Because the Complex did not receive the request, it did not violate the Act by failing to respond.

4. OAG 20-08

Under Section 55 of the Kentucky Constitution, the effective date of legislation passed by the 2020 Regular Session of the Kentucky General Assembly, except for general appropriation measures and those containing emergency or delayed effective date provisions, is Wednesday, July 15, 2020, since 90 full days will then have passed after final adjournment on April 15, 2020.
