In Kentucky, retention of open records requests is governed by records retention schedules adopted by the Libraries, Archives, and Records Commission and promulgated into administrative regulation. They are legally binding on public agencies.

For local agencies and school districts, the retention period for open records requests is one year. For state agencies and universities, the retention period is three years.

These retention periods have been carefully vetted by the Commission — whose members represent a cross-section of interested officials and entities as well as citizens-at-large — without political wrangling or interference.
