The Kentucky Open Government Coalition will have its day in court on December 6.

The Franklin Circuit Court will hear oral arguments on cross motions for summary judgment in Kentucky Open Government Coalition v. Department of Fish and Wildlife Commission. The outcome of the case will have a significant impact on the future of the open records and open meetings laws in Kentucky. It will determine whether public officials and employees can evade accountability by conducting the public's business on private devices and accounts.

The overwhelming weight of legal authority across the country supports the public's right of access to public officials' and employees' discussions of public business regardless of the ownership or possession of the device or account on which the discussions are conducted.
