Following up on a recent post, it appears that the legal dispute involving access to PTA financial reports — submitted to the Jefferson County Public Schools under mandatory state reporting requirements — will continue.

Last month, Kentucky PTA stepped in to block JCPS's release of the PTA financial reports to public school advocate Gay Adelmann after learning that the district intended to honor her open records request. JCPS has released the PTA financial reports to the Courier Journal in response to past requests.

Although Kentucky PTA expressed a willingness to share PTA financial reports in *It's* possession with Adelmann — as a member of PTA — the private nonprofit group objects to disclosure of the financial reports to her under the open records law — and the precedent the case establishes — and will appeal the underlying open records issue to the Kentucky Court of Appeals.

This follows Jefferson Circuit Court Judge Charles Cunningham's ruling in favor of Adelmann and against Kentucky PTA's attempt to block JCPS's release of the reports.

That issue on appeal is whether the PTA financial reports are submitted to JCPS with assurances of confidentiality, are "generally recognized as confidential or proprietary," and, finally, whether disclosure of the reports by a public agency in response to an open records request "would permit an unfair commercial advantage to competitors" of Kentucky PTA and its members.

The road ahead may be a long one.
