The following Kentucky Attorney General Opinions and Open Records/Open Meetings Decisions were issued last week. The summaries are listed here. To read the cases, go to this link: https://ag.ky.gov/Priorities/Government-Transparency/orom/Pages/2020-OR…

1. 20-ORD-010 (Franklin County)

Kentucky State Police ("KSP") did not violate the Open Records Act ("the Act") in denying a request based on the nonexistence of responsive records. KSP discharged its duty under the Act by conducting a good faith search for responsive records and providing Appellant copies of all existing responsive records located.

2. 20-OMD-011 (Graves County)

The Graves County School Board ("the Board") violated the Open Meetings Act ("the Act") by failing to issue a written response to a complaint made pursuant to KRS 61.846(1) within three working days following receipt of the complaint. However, the record on appeal does not substantiate the claimed violation of KRS 61.820.

3. 20-ORD-012 (Kenton County)

The Bromley Volunteer Fire Department ("BVFD") is a "public agency" as defined by KRS 61.870(1)(h), and violated the Open Records Act ("the Act") by denying access to existing nonexempt public records.
