The following Kentucky Attorney General Open Records and Open Meetings Decisions were issued last week.

1. 20-ORD-090 (In re: Aaron Kidd/Whitley County Detention Center)

Summary: Whitley County Detention Center ("Center") violated the Open Records Act ("the Act") when it failed to respond in writing to a request for records in accordance with KRS 61.880(1), denied portions of the request without explanation, and delayed providing records beyond the statutory response period without explaining the reason for delay.

2. 20-OMD-091 (In re: Larry Richards/Fish and Wildlife Commission)

Summary: The Fish and Wildlife Commission ("the Commission") violated the Open Meetings Act ("the Act") on three occasions when it entered closed session without first providing sufficient explanation in open session. However, the exemptions cited by the Commission authorized its discussions in closed session at each meeting.

3. 20-ORD-092 (In re: Christopher Wiest/City of Williamstown)

Summary: The City of Williamstown ("City") violated the Open Records Act ("the Act") when it denied in fully a request for records that it claimed was unduly burdensome because it was able to provide some records responsive to the request.

4. 20-ORD-093 (In re: Stephen Zoglman/Daviess County Board of Education)

Summary: The Daviess County Board of Education (the "Board")

violated the Open Records Act ("the Act") as modified by Senate

Bill 150 ("SB 150") when it failed to respond to an open records

request within ten days.

5. 20-ORD-094 (In re: Jenny Patten/Cabinet for Health and Family Services)

Summary: The Cabinet for Health and Family Services ("Cabinet") did not violate the Open Records Act ("the Act") when it did not disclose test results that were confidential under KRS 333.130 or produce records that do not exist.
