Chief Justice John G. Roberts introduces the case. Counsel for Food Marketing begins his argument and barely completes his introductory remarks when he is interrupted by Justice Sonia Sotomayor's first question concerning the effect of the Eighth Circuit's adverse opinion and the US Department of Agriculture's decision not to appeal it.

An opinion is not expected in the case until next spring.
